02.12.2024 — New Risks in Real Estate Transactions in the Russian Federation
The Managing Partner of the bureau, Artem Sirota, made a speech at the annual discussion on legal issues under the auspices of the Russian-German Chamber of Commerce. Artem highlighted the new risks that are emerging in the current practice of conducting transactions with Russian real estate assets in his report.
Among such risks are:
• the problem of limitation periods for challenging real estate transactions - the position of the Constitutional Court on the non-application of limitation periods increases the risks of purchasing the objects that were previously owned by government employees;
• the risks of purchasing a building with unauthorized reconstruction in the context of current case law, where the Supreme Court is looking for ways to protect the owners who have already purchased objects in the reconstructed form;
• stricter liability of the parties to the transaction for non-compliance with the counter-sanctions legislation, when the failure to obtain the approval of the Government Commission for the transaction may become the ground for the return of the real estate sold in the transaction.
